Total Dental Sleep Solutions ("we", "our", "us") operates this website and the provider portal at providers.totaldentalsleepsolutions.com (together, the "Site"). These Terms of Use ("Terms") govern your use of the Site. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

The Site gives general information about obstructive sleep apnea and oral appliance therapy, helps patients find dentists trained in dental sleep medicine, and gives member providers and their staff access to training, tools, and practice support through the provider portal.

The content on the Site is for general information only. It is not medical or dental advice, a diagnosis, or a treatment plan, and it does not replace a visit with a licensed physician or dentist. Screening tools on the Site, including the sleep screener, give a general indication only and are not a diagnosis. Using the Site does not create a doctor-patient or dentist-patient relationship with us. Always ask a qualified health professional about your own situation. If you think you have a medical emergency, call 911.

Dentists listed on the Site are independent practitioners. They are not our employees or agents, and they alone are responsible for the care they provide. A listing is not a guarantee of any result, of availability, or of insurance coverage. Coverage and eligibility are decided by your insurer or benefits program, not by us.

Information about insurance, VA or other benefits, costs, and financing is general and may change. It is not a quote or a promise of coverage or approval. Any financing is offered by third parties under their own terms.

The provider portal is for member providers, their authorized staff, and our team. If you have an account, you agree to give accurate information, keep your login details confidential, not share your account, and tell us promptly if you believe your account has been used without permission. You are responsible for activity under your account. Providers are responsible for the staff accounts they add. We may suspend or close an account that is misused or that breaks these Terms. Membership fees, services, and training are governed by your membership or training agreement with us. If that agreement and these Terms conflict, the agreement controls.

You agree not to:

• use the Site for anything unlawful, harmful, or misleading;
• try to access accounts, data, or systems you are not authorized to use;
• interfere with the Site's operation or security, or introduce malicious code;
• use automated tools to scrape, copy, or overload the Site;
• submit false information or impersonate another person;
• send spam or unsolicited messages through any form on the Site;
• enter patient health information into any part of the Site that is not designed to receive it.

The text, graphics, logos, training materials, videos, and other content on the Site belong to us or our licensors and are protected by copyright, trademark, and other laws. You may view the public content for your own personal, non-commercial use. Member providers may use portal materials in their own practice as their membership allows. Otherwise you may not copy, republish, sell, or create derivative works from Site content without our written permission.

When you submit a form, message, or other information, you confirm it is accurate and that you have the right to share it. We handle personal and health information as described in our Privacy Policy, which is part of these Terms.

If you give us your email address or phone number, you agree that we may contact you about your request, your account, or our services. You can opt out of marketing messages at any time by following the instructions in the message or by contacting us.

The Site may link to websites we do not control, including provider practice websites. We are not responsible for their content, policies, or practices. Use them at your own risk.

The Site and its content are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. To the fullest extent the law allows, Total Dental Sleep Solutions and its owners, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of, or inability to use, the Site. Our total liability for any claim arising from the Site or these Terms will not exceed one hundred US dollars (US $100) or the amount you paid us in the twelve months before the claim, whichever is greater. You agree to defend, indemnify, and hold harmless Total Dental Sleep Solutions and its owners, officers, employees, and contractors from any claim, loss, or expense, including reasonable attorneys' fees, arising from your misuse of the Site or your breach of these Terms.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any membership or training agreement you have with us, are the entire agreement between you and us about the Site.
